Yes. A wrongful death settlement in Missouri must be court approved, and, if applicable, apportioned by the court. A settlement (or a jury award) must be apportioned among those entitled to sue (whether are not all joined settlement negotiations or suit).
If two or more persons are entitled to sue, then any one of them may settle the claim with approval from the court, provided that person satisfies the court that a diligent attempt has been made to notify all parties entitled to join in settlement or suit.
If an agreement is reached before a lawsuit is filed, a “friendly” suit has to be filed so that the settlement can be approved by the court.
